JAKARTA, KOMPAS.com- The discourse on limiting the term of office of general chairs of political parties (parpol) is once again in the public spotlight.

申请人针对《政党法》第二十三条第一项“政党各级领导班子变更，依照《政党法》和《政党法》的规定”提起诉讼。

申请人认为，没有任期限制为权力集中提供了空间，并阻碍了党内的政治复兴。
“The norm of Article 23 paragraph (1) of the Political Parties Law which completely delegates the regulation of the term of office of the General Chairperson of a political party to the AD/ART without constitutional restrictions has opened up space for the concentration of power within political parties,” said the applicant’s representative, Irpan Suriadiata.
作为民主制度下履行公共职能的组织，政党领导被认为必须遵守限制权力的原则，以防止寡头政治的出现。
“Because political parties carry out public functions in a democratic system, their leadership must comply with the principle of limiting power,” said Irpan.

In his petitum, the applicant asked the Constitutional Court to declare that Article 23 paragraph (1) of the Political Party Law is contrary to the 1945 Constitution of the Republic of Indonesia and does not have conditionally binding legal force, as long as it is not interpreted as follows:
“Change of Political Party management is carried out democratically, and the term of office of the General Chair of a Political Party or other designation in accordance with the articles of association and bylaws of a political party is limited to a maximum of 2 (two) terms, either consecutive or non-consecutive.”
The proposal to limit the term of office of general chairmen of political parties was once proposed by the Corruption Eradication Commission (KPK).
